J. Mark Weiss—Mediator
Before retooling himself in consensual dispute resolution, Mark was a successful conventional lawyer-litigator. Before graduating from law school, Mark worked as a law clerk, writing contracts and legal briefs, doing legal research, and otherwise assisting with trials and appeals. Mark also served as an extern clerk for the then-Chief Judge of the U.S. District Court for Oregon.
Upon becoming a lawyer in 1987, Mark worked in the construction and litigation departments of Ferguson & Burdell in Seattle. Since 1990, Mark has been a principal in two law partnerships and a sole practitioner in a professional services corporation. In addition to family law, he handled a wide range of cases including construction claims, insurer insolvency and reinsurance law, tax appeals, business disputes, property (real estate) claims, employment law, personal injury, bankruptcy adversary proceedings, and other commercial cases. He handled litigation in state and Federal courts, including substantial trial experience and appeals. His practice also included forming and advising small businesses (corporations and partnerships), structuring real estate transactions, negotiating and closing corporate acquisitions, and estate planning. Over time, family law became Mark’s dominant practice area.
Having retired from litigation in January 2007 and from Collaborative Law in 2020, Mark now works as a divorce and separation mediator.

- 1996: Washington State Bar Association Mandatory Alternative Dispute Resolution Rule Task Force.
- 1999: Member, WSBA Amicus Brief Committee for two years. Reappointed for another one-year term in 2003.
- 2000: Washington Supreme Court Chief Justice Richard Guy appointed Mr. Weiss to serve on an ad hoc committee to solve issues relating to privacy of litigants in family law cases, which led to the adoption of General Rule 22, “Access to Family Law Records.”
- 2001: Mark participated on a court committee concerning “portability” of judges between court levels. He also became a member of the Committee for Cost-Effective Justice, which spearheaded the adoption by the voters of a Constitutional amendment to make more efficient use of judges.
- 2002: Appointed by the Washington Courts to an ad hoc committee to help formulate an electronic filing court rule. The rule drafted by the committee was adopted by the Supreme Court as General Rule 30.
- 2002: Representative of the King County Bar Association to the King County Superior Court’s Electronic Court Records Executive Sponsor Committee.
- 2003: King County Superior Court work group to draft the King County Local Family Law Rules.
- 2003: Supreme Court Justice Bobbe Bridge appointed Mr. Weiss to a work group to make recommendations for revisions to court rules GR 15 and 22 to help balance privacy interests in court procedures and file access.
- 2003-04: Liaison for King County Bar Association to King County Superior Court Local Rules Committee
- 2005: Chaired a subcommittee of the Judiciary and the Courts Committee of the King County Bar Association to draft pattern family law interrogatories.
